New York Free Arrest Records

By Ben Kingsley

Since the Freedom of Information Act has been in place, NY criminal records have been opened to the public. However, access to this document is limited only to the person involved. This means that, although the document is a public file, only the person whose name is on the file is allowed to request it. Those who need to access it should have a special request before they will be allowed to access the files of others.

New York Criminal records include the arrest files of the state. Arrest records are generated when an individual has committed some crimes or violations to the law. A person can have multiple arrest records from coming from different law enforcing agencies of the state such as the police department, sheriff's office or the highway patrol. Therefore, arrest records can be requested at the government office that issued the report.

As the name suggest, an arrest record focuses on the details of the arrest. Information such as where and when the arrest was done is documented on the file along with other important details like the case number and the crimes that the individual has committed that lead to his/her arrest. The document would not be complete without some of the personal information of the reported individual such as the place and date of birth and the latest place where he resided. The document would also show all the charges that were filed against the individual as well as the sentence that he/she received for the crimes that was committed. One should know that the document is only available to the public after investigation has been closed or the case has been resolved.

The Court Administration of New York is the one who is responsible for managing the criminal records of the state and this includes the arrest records. Many would think that they can conduct a nationwide criminal check but the only thing possible at the moment is a statewide search. With this, one can only find criminal records for a particular state and not that of the whole country.

Retrieval of a criminal and arrest record would mean knowing the basic information of the record being obtained. One has to fill out the search form provided by the state office with the information about the arrest to get a certified copy of the document. A $65 processing fee has to be paid in order to proceed with the retrieval process. Requests can be done personally at the state office or by sending a mail request. However, the results of a mail request will be sent only after a few days.

Delay can be avoided if the search is done over the Internet. This method has made the retrieval process easy and fast. Getting arrest records for free through the Internet is also possible. Some websites lets its users to test their system and then after a few days, users can choose to end the free trial or continue with the service by paying for it.
