For Lawyers In Uncontested Divorce Chicago Is The Way To Go

By Daniel Stone

The thousands of Americans that divorce each year have made divorce a major issue of concern in the US. In the course of history, divorce rate is at its highest at the moment. This has created a huge market for lawyers to specialize in marriage issues. The demand for lawyers who specialize in family and marriage issues is growing as more professionals join this subspecialty of the law profession.

Divorces can be categorized based on various criteria. In one criterion, divorces are classified depending on the agreement between the divorcing couple. If the couple disagrees on how property, children, and debt should be divided, they usually take the matter to court. When this happens, the marriage is dissolved through a trial in what is called a contested divorce. On the other hand, if there are no disagreements, it is called an uncontested divorce. To learn more about uncontested divorce Chicago is the best location to visit.

Uncontested divorces end peacefully as the couple seeks to dissolve their marriage with dignity and in a respectful manner. The couple often remains in agreement on matters such as property division, division of debt, custody of children, and payment of spousal and/or child support. Since the two partners agree on how to divide what they own, there is no need of moving to court. They resolve their own issues amicably at home without a trial.

There are two situations in which a non-contested divorce can take place. The second situation besides the couple agreeing on everything is when one partner does not show up for the marriage dissolution action in court. That way, all the demand of the partner who appeared are granted by the court. This happens unless if the absent party has a reason that the court may consider worthwhile for being absent.

The main advantage of this kind of marriage dissolution is that it is relatively inexpensive. When the couple remains in agreement regarding the terms of the dissolution of marriage, they remain in control of the expenses they incur. Agreeing on the terms of the dissolution eliminate the huge expenses incurred in paying for attorneys and other related costs. Attorney costs can be very high in some places and especially if the couple has a lot of property.

The level of disagreement is another factor that may raise the attorney fee substantially. Negotiation is often opted for in resolution of minor disagreements between partners to reach a resolution that is suitable for both people. However, in major disagreements, an attorney may need to be hired to resolve the disagreement. Major disagreements also make the process of marriage dissolution to move slowly, resulting into months or even years of attorney fees.

Even in marriage dissolution that is not contested, some people choose to have legal representation from an attorney. An attorney hired in such a case can only represent one partner. It is not allowed for both partners to be represented by a single attorney. As such, the attorney will want to know who their client is at the start of the proceedings.

It is also possible for one to represent themselves in these cases. Such people usually have some background in law, but it is not always. Even though this happens, it is not advisable.
